Terror suspect may escape Spain warrant

A French Basque man facing terrorism charges in Spain may escape being handed over to Spanish police by French authorities, a prosecutor said on Wednesday.

State prosecutor Marie-Helene Heyte called on an appeals court to consider the “compulsory non-handover” of Daniel Derguy, 51, under a European arrest warrant issued by Spain.

He is considered the leader in France of the Basque armed separatist group ETA and is accused of sending a letter bomb from France to a Spanish Basque company in 1994.

If the court decides to agree to the Spanish request, Derguy would be the first French national to be handed over to Spain under such a warrant. A French woman targeted, Aurore Martin, 32, is on the run from arrest.

The “non-handover” procedure allows a court in a European country to refuse a foreign warrant if the suspect can be tried in one of its own courts or if the statute of limitations has expired under its law.

The appeals court in Agen, southwestern France, said it would give a judgment on August 17th.

Police in Milan said on Thursday they had arrested a 37-year-old Algerian man in the subway, later discovering he was wanted for alleged ties to Islamic State.

When stopped by police officers for a routine check, the man became “particularly aggressive”, said police in Milan, who added the arrest took place “in recent days”.

He was “repeatedly shouting ‘Allahu Akbar’ while attempting to grab from his backpack an object that turned out to be a knife with a blade more than 12cm (nearly five inches) long,” they said in a statement.

The man was later found to be wanted by authorities in Algeria, suspected since 2015 of belonging to “Islamic State militias and employed in the Syrian-Iraqi theatre of war,” police said.

Police said the suspect was unknown to Italian authorities.

The man is currently in Milan’s San Vittore prison and awaiting extradition, they added.

Jihadist group IS proclaimed a “caliphate” in 2014 across swathes of Syria and Iraq, launching a reign of terror that continues with hit-and-run attacks and ambushes.
