Can French public transport services guarantee safe travel for passengers?

As France prepares to begin to lift its strict nationwide lockdown on May 11th, transport workers prepare for an influx of commuters on trains, buses and Metros. But rail companies say they 'lack necessary means' to ensure the safety for everyone.

As of next week, when France takes its first steps towards some kind of return to normality, the number of people taking public transport every day will inevitably increase as employees return to work.

But French rail companies have sounded the alarm that they cannot guarantee the safety of passengers under the current circumstances.

In a letter written to French Prime Minister Edouard Philippe, the bosses of SNCF, RATP, Keolis and AGIR – which together represent over 90 percent of all public transport networks- said “operators do not have the means necessary” to ensure a safe travel for all of their passengers from May 11th.

The letter was obtained by French daily Le Parisien.

“We consider it our duty to inform of the very high risk of public disorder that will necessarily lead to halting public transport,” the signatories stated.

The heads of the rail companies said they lacked both in material (especially masks) and personnel to ensure that everyone can travel while respecting the government's national health advice. 

They told the PM that “mobilising police, national and local, will be an indispensable condition to regulate the flux” of passengers.

'Irresponsible'

The rail companies' call for help has been echoed by several rail unions.

“It's irresponsible to reopen society like this,” said Matthieu Bolle-Reddat, General Secretary of the CGT union representing rail workers in Versailles, southwest of Paris.

The CGT union is a hardline union that spearheaded the December transport strikes protesting the government's pension reform plans.

Bolle-Reddat, who is a train driver on the Paris suburban Transilien rail service, told The Local that, rail companies would not be able to ensure for the safety of either passengers or drivers if numbers significantly increased as of next week.

“We don't have enough personnel to clean the trains, and we don't have enough staff to ensure that passengers maintain security measures inside the trains,” he said.

Bolle-Reddat was working on Monday and said the situation right now was “quite good.” 

“Only key workers are taking public transport so the stations are pretty empty,” he said.

The number of daily commuters in the Paris region has been reduced to about four percent since most of the country’s workforce was confined to their homes on March 17th.

At the same time, railway services have been operating at a bare minimum. In Paris, Metro, bus and tram services were slashed to about 30 percent.

Most of the services operating have been concentrated in the suburb of Seine-Saint-Denis, which has a high number of key workers such as healthcare workers, street cleaners and supermarket staff who commute into Paris.

In the tweet below, Le Parisien has sketched out a scenario where the Paris’ Metro is complying with general health advice on social distancing.

If the passengers are to keep the required one metre between themselves, each metro train can carry up to 160 people at the time, 32 people per carriage.

 

Bolle-Reddat said he worried about how the rule that commuters must wear a face mask on public transport would be enforced.

“We transport around 12 million people every day,” he said.

“Let's say we cut that in two, that means 6 million people will be travelling with us every day. Who is going to make sure all of these people use a mask?” 

'Our duty to serve the nation'

If rail workers deemed conditions to be unsafe, Bolle-Reddat said, CGT called on them to make use of their “droit de réserve,” (reservation right) which is the right to withdraw from a workplace that is not complying with safety rules.

The Unsa union – which represents the highest number of workers in the Paris RATP transport service – has asked their workers to do the same if work conditions aren't “perfect,” the union told France Info.

Making use of the reservation right would not entail workers staying home, Bolle-Reddat explained, but it could mean them staying in their offices until “necessary measures” were taken. In practice, this could entail pausing trains to wait for a cleaner to come, for example.

“At the moment, we are not calling on workers to strike,” the CGT union member said, “because we serve a lot of stations close to hospitals.”

Right now, he said, transporting key health workers to their workplace was more important.

“It's our duty to serve the nation,” he said.

'New phase'

The government is currently in the process of thrashing out a detailed plan for how to lift the lockdown in each of France's 101 départements.

“The confinement has been effective, it’s worked, there was no other solution,” said French President Emmanuel Macron during a press conference on Monday.

“Now we’re in a new phase (..) and we need to learn how to live with the virus.”

This new phase will involve ramping up the country's public transport services.

As of next week, in Paris, the Metro service should be reaching 70 percent of its normal service.

Lines 1 and 14, which are automated, services will run at 100 percent.

Paris mayor Anne Hidalgo has however declared that, those who can, should use alternative means to avoid overcrowding the public transport services. 

Her office has also said it is working on a plan to expand bike lanes and create new temporary lanes along the route of several Metro lines. 

The national rail company SNCF will also run on a strictly limited service as of May 11th, according to French daily Echos.

Only 15 percent of the country's high speed TGV trains will run as of next week, up from 7 percent at the moment. This is much less than the originally reported 50 to 60 percent-of-normal service. 

That means between 80 and 90 TGV trains will run every day, against 600 on a normal service day.

Tickets will be restricted to half of the seats of the train to ensure that users may comply with social distancing measures.

The SNCF hopes to restore its services to 100 percent at the beginning of June.

What’s the deal with passport stamping in France?

There are clear guidelines in place about who should have their passport stamped when they enter or leave France - but the letter of the law doesn't always seem to be applied on the ground. Here's what you need to know.

What's the deal with passport stamping in France?

When you pass through a French border control post, officers will check your passport and – in some cases – stamp the date of your entry or exit of the country onto one of the blank pages in the booklet.

Although the system should be clear and simple, it becomes complicated when conflicting information is given on the ground.

Here’s what the rules say, and whether it’s really a problem if your passport is incorrectly stamped.

Who should be stamped?

The purpose of the date stamps for entry and exit is to calculate how long you have been in France, and therefore whether you have overstayed your allowed time – whether that is the time allowed by a short-stay Schengen visa or the visa-free 90-day allowance that certain non-EU nationals benefit from. 

Those people who are exempt from 90-day restrictions should therefore not have their passports stamped.

EU passport – people who have an EU passport should not have it stamped, because they have the right to unlimited stays due to EU freedom of movement.

Dual nationals – people who have passports of both EU and non-EU countries should not be stamped when they are travelling on their EU passport. However, because the passports of dual nationals are not ‘linked’, those travelling on their non-EU passports will be stamped, unless they have other proof of residency.

French residents – the passports of non-EU citizens who have a residency permit in France (carte de séjour) should not be stamped, because they have the right to stay in France for as long as their permit is valid.

Visa holders – people who have a long-stay visa or a short-stay visitor visa should not be stamped, because they have the right to stay in France for as long as their visa is valid. 

Tourists/visitors – people making short visits to France who do not have a visa should be stamped, with the stamps keeping track of their 90-day allowance. Visitors from nationalities who do not benefit from the 90-day rule (eg Indians) are also stamped.

Travel practicalities

When crossing a French border, you should present your passport along with other documents – visa or carte de séjour – if relevant. Don’t wait for border guards to ask whether you are a resident.

It should be noted that the carte de séjour is not a travel document and cannot be used to cross borders, not even internal Schengen zone borders. The only valid travel documents for entering France are a passport or national ID card. Any other forms of ID – driving licence, residency card etc – cannot be used for travel purposes.

Border problems

While the rules on stamping are simple in theory, many readers of The Local have reported having their passports incorrectly stamped at the border, and this seems to be a particular problem for non-EU nationals who are resident in France.

Travellers are also often given incorrect information by border guards – for example being told that only holders of the post-Brexit Article 50 TUE carte de séjour are exempt from stamping, that all non-EU nationals must have their passports stamped or that only being married to a French national exempts you from stamping.

None of these are correct.

It’s also sometimes the case that people whose passports should be stamped – tourists, visitors and second-home owners who don’t have a visa – do not receive the stamp. For frequent visitors this can be a problem because it looks as though they have had a long stay in France, due to their exit not being recorded.

The system of stamping itself is also a bit haphazard with stamps scattered throughout the passport book in random order, so border guards sometimes make mistakes and miss an entry or exit stamp and therefore think that people have overstayed when they haven’t.

So how much of a problem actually is it if your passport is wrongly stamped?

It’s one thing to know the rules yourself, it’s quite another to have an argument with a border guard, in French, when a long queue is building behind you. Numerous Local readers have reported feeling that they had no choice but to accept a stamp when an implacable guard insisted upon it.

But is this really a problem?

One thing is clear – if you are a resident of France then you have the right to re-enter, and your proof of residency (visa or carte de séjour) takes precedence over any passport stamps. So it’s not a question of being barred from the country – it can, however, be inconvenient as it might lead to delays at the border while your passport record is queried.

Meanwhile people who did not receive correct exit stamps can be incorrectly told that they have over-stayed and even be liable for a fine. 

Will the new EES passport control system improve this?

Theoretically, the EU’s new Entry & Exit System – which does away with the manual stamping of passports – should get rid of these problems.

However, as we have seen, theory and what actually happens on the ground are two different things.

The EES system, due to come into effect later this year, brings in two main changes – it makes passport checks more secure by adding diometric data such as fingerprints and facial scans and it does away with manual stamping of passports and replaces it with scans which automatically calculate how long people have been in France.

So that should eliminate the problems of unclear stamps, stamps being read wrongly or passports not getting the stamps they need.

Residents in France – carte de séjour and visa holders – are not required to complete EES checks and should have a separate system at ports, airports and railway terminals.

However, at present it’s pretty common for border guards to give incorrect information to non-EU residents who are resident in the EU – let’s hope that they are properly briefed before EES is deployed.
