France's National Assembly on Wednesday lifted the immunity from prosecution of far-right leader Marine Le Pen for tweeting pictures of Islamic State group atrocities, according to reports.

The decision was taken by a cross-party committee in charge of the internal functioning of the assembly, after a request from the authorities to lift Le Pen's parliamentary immunity over a crime that carries up to three years in prison.

The leader of the National Front, who ran a failed campaign for president this year, in 2015 tweeted three pictures of IS atrocities, including one of
James Foley, an American journalist beheaded by the extremists.

“Daesh is THIS!” she wrote in a post accompanying the photos, using an Arabic acronym for IS.

Faced with outrage on social media and from Foley's family, Le Pen later deleted the picture of the American, saying she had been unaware he was the man in the picture.

French authorities launched an investigation into the incident but could not press charges while Le Pen had protection from prosecution.

At the time Le Pen was a member of the European Parliament.

That assembly voted in March to lift her immunity over the pictures but three months later she won it back after being elected to the French parliament.

Wednesday's decision of the 22-member Assembly committee is the latest blow to the 49-year-old politician, who has appeared adrift since suffering a sound defeat at the hands of Emmanuel Macron in May's presidential runoff.

After proving a formidable opponent, Le Pen lost to Macron with 33.9 percent to his 66.1 percent of the vote after floundering badly in a final TV debate between the pair.

The party also fared badly in June parliamentary elections, taking just eight seats out of 577 — too few to have much of an impact on lawmaking.

In September, tensions between rival party factions — one led by anti-immigration hardliners, the other by anti-EU nationalists — burst into the open with the resignation of Le Pen's right-hand man Florian Philippot.

Philippot devised Le Pen's strategy of detoxifying the FN brand and her unpopular promise to pull France out of the eurozone if elected president.

Jean-Marie Le Pen, founder of France's far-right National Front party, refused to submit to police questioning last month as part of an EU funding inquiry, claiming immunity as a European Parliament lawmaker, his adviser said Sunday.

Le Pen is one of several party MEPs suspected of using European Parliament funds provided for assistants to pay more than 20 France-based party staff.

If convicted, the party could be ordered to repay €7 million ($8.2 million), and the judges pre-emptively seized the subsidies.

An EU tribunal has already determined that Le Pen must reimburse €320,000.

But when police from France's anti-corruption squad tried to question him last month at his office just outside Paris, he claimed MEP immunity and ordered them to leave.

“He was prepared to receive them, but they had such arrogant attitudes which Jean-Marie Le Pen refused to accept,” his adviser Lorrain de Saint Affrique told AFP, confirming a report in the Journal du Dimanche newspaper.

Le Pen, 90, sits as an independent after being thrown out of his party by his daughter Marine Le Pen in 2015 for saying the Nazi gas chambers were a mere “detail” of history.

He has also often made disparaging statements against Muslims and Roma which have earned him a string of hate speech convictions.

His daughter has renamed the party the National Rally in an effort to shed its xenophobic and anti-Semitic image.

The EU funding inquiry has led French judges to withhold €2 million of public subsidies for the party, a move which Marine Le Pen has denounced as a “death sentence”.

Without the funds, she warns the party will be bankrupt by September.
