Girl, 16, charged for sex with underage boys

A teenage girl from Kungsbacka in western Sweden was charged on Tuesday with sexual abuse after having sex with two boys who were 13-years-old at the time.

Prosecutor Lena Lithner of the Halmstad public prosecution office filed the charges against the girl, who was 15 at the time, at Varberg district court on Tuesday, news agency TT reported.

Sex with minors under 15 years old is a crime that can be classified as statutory rape, but when the age difference is small, suspects are typically prosecuted for sexual abuse.

The incident took place in an apartment in Kungsbacka, a town south of Gothenburg on the west coast on March 27th, the Aftonbladet daily reported on Wednesday, adding that the girl was acquainted with the victims, who are now 14.

The girl, now 16, has admitted to the circumstances, but denied that she has committed a crime. The basis of the indictment was the testimonies of the alleged victims’ mothers and they will be called to the stand when the trial begins on November 8th.

Prosecutions for these kinds of crimes are uncommon, the girl’s lawyer Elisabeth Johansson told Sveriges Radio (SR) on Tuesday. She is surprised that Lithner decided to pursue this case.

“I do not believe that the law was created for these types of cases,” Johansson told SR.

Detective chief inspector Inger Ohlsson of the county criminal investigation department disagreed.

“We have a law that says one should not have sex with someone else who is under 15. I think that one should follow the law regardless of whether one is a girl or boy,” she told Radio Halland.

Attempts by The Local to reach both Lithner and Johansson were unsuccessful.
