Makatsch, who has filmed with Hugh Grant and once dated James Bond star Daniel Craig, had demanded €35,000 from publisher Bauer Verlag for printing pictures of the 36-year-old taking her eight-week-old daughter for a stroll along Berlin’s Spree River.
The court ruled the publication of the paparazzi photos was illegal, however, they did not present a serious invasion of Makatsch’s privacy since they did not show mother and child in a negative light or in a private setting.
“To rule differently would sanction monetary compensation for every photo printed without permission. That wasn’t and isn’t intended by the law,” said Judge Thomas Steiner.
Makatsch’s lawyer said he’d been “completely surprised” by the decision and that he would “most certainly” appeal.
“Especially children of prominent people have the right to grow up shielded from the media,” he said.
