Nor will the matter of a corporate fine for the supplier be raised in the trial since it has not been possible to interview the director since August 2003.
“There are obstacles in the case against the individual and the company but not against the others who have been charged,” said the district court judge, Thore Brolin, after the decision.
The prosecutor wants the Board of Social Care’s legal panel to assess the managing director’s health but the court judged that there was nothing to be gained from that.
Several of the representatives of the other defendants want to question the director and said that his absence therefore also presents obstacles for the trial of their clients.
The lawyer for the managing director of Vin-Trägårdh, Per Liljekvist, left the courtroom directly after the decision to drop the case against his client.
“I am satisfied that he will not be forced to take part in a trial. He is not well,” said Liljekvist.
The man underwent an operation for heart trouble a few weeks ago and was fitted with a pacemaker.
Regarding the case against Vin-Trägårdh’s managing director, Liljekvist said that it would now be left to one side.
“I’m not going to do anything, but the trial of the others will proceed,” he said.
